IV Push Timer

POLICIES AND INFORMATION

Terms of Use

Prepared October 28, 2026. The acceptance workflow describes the intended release, not a shipped build.

Spreckels Media Group operates IV Push Timer. In these Terms, “we” and “Developer” refer to Spreckels Media Group, and “App” means IV Push Timer for Apple Watch and its iPhone companion. For support or privacy inquiries, contact ivpushtimer@gmail.com.

Important notice before you agree

IV Push Timer is for simulation only. Do not use the App with real patients or for actual patient care. It does not determine whether medication administration is safe.

These Terms contain a qualified warranty disclaimer. They do not impose a monetary liability cap, exclude categories of economic damages, release claims, require indemnification, compel arbitration or waive jury or class-proceeding rights. Mandatory legal rights remain intact.

Read the complete Terms of Use and Privacy Policy on iPhone before deciding whether to agree. If you do not agree, select Cancel and do not use the App. Cancel records no acceptance and leaves the App locked. Applicable refund and mandatory consumer rights remain intact.

1. Acceptance

On iPhone, selecting the initially unchecked agreement checkbox and then selecting Agree records acceptance of the identified Terms revision. Agree is unavailable until the checkbox is selected. Selecting the checkbox alone is not acceptance. The acceptance screen must provide access to the complete Terms and Privacy Policy before acceptance. No name, email address, typed or drawn signature, or personalized PDF is required or collected by this workflow. Do not provide patient information.

Apple Watch remains locked until it receives a current acceptance receipt for the same paired installation from iPhone. Watch has no independent Agree action. A prior Watch acknowledgment or legacy acceptance flag does not substitute for current iPhone acceptance. Once a current receipt has synced, that same paired Watch installation may work offline; offline operation does not bypass initial receipt delivery or a required new agreement.

Acceptance does not certify qualifications, clinical readiness, reading of every word, safety or measurement accuracy. A technical receipt records an interaction, not verified identity or conclusive enforceability. These Terms do not purport to waive rights of patients, an employer or other nonparties.

2. Existing license and permitted use

These Terms describe safety and use conditions; they do not grant a new software license or replace the license otherwise applicable to the App through Apple. Nothing in these Terms changes App Store Connect license settings. Applicable Apple terms, Usage Rules and third-party licenses remain controlling within their scope.

Use the App only for simulated activities, never for real patients or actual patient care. This restriction does not establish regulatory status or approval. Do not interfere with security or use the App unlawfully or in violation of third-party rights. Nothing here restricts rights that applicable law does not permit restricting.

3. What the App does and does not do

The Apple Watch app provides stopwatch timing with optional cues and history. The iPhone companion provides settings, setup guidance and received history. The iPhone is not an independent backup timer or a real-time patient monitor.

The App does not assess a patient, verify a medication, select treatment, calculate doses or infusion rates, provide medication-specific administration protocols, or determine whether medication can be administered safely. Stopwatch controls and cues are timekeeping controls, not medication instructions. A stopwatch reading, completion signal or history entry does not authorize starting, continuing or completing medication administration and does not prove that medication was administered or care completed safely.

The App does not replace professional judgment, clinical training, current orders, authoritative medication references, institutional policies, required monitoring or the applicable standard of care.

4. Risks, professional responsibilities and safeguards

Timing errors, missed or delayed alerts, incorrect settings, unintended starts, device failures and reliance on inaccurate displays or history can contribute to medication errors, serious injury or death. Do not use the App as the sole means of timing a time-critical procedure. Maintain an appropriate independent timing method and a practiced backup workflow.

Do not use simulated records or timing cues as evidence of actual treatment. The App cannot assess a patient or detect an adverse reaction.

Confirm the actual Watch stopwatch state and elapsed time, pause state, cue settings, Auto Timeout and battery before relying on a session. A shortcut or complication launch may start an idle stopwatch if its separate Auto-Start setting is enabled. Verify the actual start rather than assuming a button press or spoken command succeeded.

If timing or App behavior is uncertain, stop the simulated activity and verify the setup. These checks do not transfer Developer responsibilities to you.

5. Operating limitations

watchOS controls display dimming, sleep, return to the watch face, notification presentation and runtime. Always-On support does not guarantee a continuously visible or current display. Haptics, audio and notifications can be missed, suppressed, duplicated or delayed because of settings, permissions, device state, scheduling or software/hardware failures. A background notification does not prove the timer display is current.

Battery depletion, process termination, restart, system clock changes, connectivity loss and other interruptions can affect timing, alerts, settings or history. Active-session recovery after termination is not guaranteed. Decimal places on a display are not evidence of validated measurement accuracy.

Auto Timeout is an elapsed-running-time limit, not an inactivity detector or screen-awake control. It can complete and log a session and stop alerts when the elapsed-running-time limit is reached. Paused time is excluded. Disabling Auto Timeout does not guarantee unlimited background execution or alerts. With Auto Timeout Off, stopwatch background interval notifications are scheduled only through 15 minutes of elapsed time.

6. History, personal information and agreement records

The App stores settings and timer records locally. Timer records include a generated identifier, date/time, duration and mode. Apple Watch sends history to the paired iPhone, and iPhone sends settings to Apple Watch through WatchConnectivity. Data can exist on both devices; transfers may be delayed and displayed history/settings may be stale.

The Watch retains up to 50 completed records. History is a convenience log, not a medication administration record, proof of treatment, validated audit trail or substitute for required clinical documentation. A new completion can result from a tap or Auto Timeout. Legacy countdown completions from earlier versions may remain in history, transfers and backups; they are historical records, not an available countdown feature. The App has no patient-name, medication-name, dose or clinical-note entry fields. Do not include patient information in agreement records or send it to support. Even timestamps can become sensitive when linked to a patient or clinical event.

To document this Agreement, the proposed acceptance process stores an on-device receipt of the identified agreement revision, checkbox-and-Agree action and device-reported acceptance time on iPhone. The paired Watch receives the acceptance state needed to unlock for the matching revision; receipt of that state is not a separate Watch acceptance. No name, email address, signature, personalized PDF, acceptance email delivery or Developer-server collection is part of this workflow.

Your agreement record is separate from clinical/timer history. It must not include patient identifiers, medication information or timer-session history. Acceptance is not consent to marketing. This on-device workflow does not collect agreement contact information for marketing or delivery.

The Privacy Policy explains local storage, synchronization, backups, support communications and the approved agreement-record workflow. Reviewing or acknowledging that policy is not blanket consent to unrelated processing. Mandatory privacy rights remain intact. A deletion request may be subject to lawful, disclosed record-retention duties or a legal hold, but we will not claim indefinite retention without a lawful basis.

7. Warranty disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP AND DEVELOPER-PROVIDED SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS. DEVELOPER DISCLAIMS EXPRESS, IMPLIED AND STATUTORY WARRANTIES AND CONDITIONS, INCLUDING MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, QUIET ENJOYMENT AND NON-INFRINGEMENT, TO THE EXTENT THOSE WARRANTIES OR CONDITIONS MAY LAWFULLY BE DISCLAIMED.

DEVELOPER DOES NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION, EXACT TIMING, CURRENT DISPLAYS, SUCCESSFUL ALERT DELIVERY, COMPATIBILITY WITH EVERY DEVICE OR SYSTEM UPDATE, RECOVERY OF INTERRUPTED SESSIONS, CLINICAL SUITABILITY, OR PATIENT SAFETY.

This disclaimer does not negate an express warranty that applicable law makes binding, excuse a misleading representation, or exclude a statutory guarantee, remedy, refund or obligation that cannot lawfully be excluded. General support information does not create an additional warranty except where applicable law provides otherwise. Some jurisdictions do not permit some or all of these exclusions; in those jurisdictions the disclaimer applies only to the extent permitted. Section 8 controls over any inconsistent disclaimer. These Terms do not alter rights or obligations under the otherwise applicable Apple license.

8. Liability and mandatory rights

These Terms impose no monetary cap on liability, exclusion of specified economic losses, release of claims or obligation to defend or indemnify Developer. Acknowledgment of risks and safety responsibilities is not a waiver of claims or a transfer of Developer responsibilities. Liability and available remedies remain subject to applicable law and any otherwise applicable license, not a new limitation created by these Terms.

Nothing in these Terms excludes or limits liability or remedies that applicable law does not permit excluding or limiting, including applicable consumer, privacy and product-liability rights. These Terms do not waive claims for death or personal injury, fraud, intentional wrongdoing, recklessness or gross negligence, or claims belonging to nonparties. The warranty disclaimer applies only within its lawful scope.

9. Disputes and applicable law

These Terms do not require arbitration, impose an arbitration opt-out process, waive a jury trial or class or representative proceeding, or select a governing jurisdiction or exclusive court. Applicable law and ordinary jurisdictional rules determine available forums and remedies, subject to any otherwise applicable agreement. These Terms do not replace or enlarge dispute provisions in a separate applicable license. Nothing here limits lawful reporting to regulators, law enforcement or professional authorities.

10. Changes and ending use

You may stop using the App at any time. These Terms do not create a new power to terminate the otherwise applicable software license. Ending use does not erase accrued claims or mandatory refund, consumer or privacy rights.

A required new Terms revision requires a new affirmative decision on iPhone and a current receipt on Watch. An earlier acceptance or continued use alone does not accept a required new revision. Changes do not retroactively remove accrued rights. You may decline revised Terms; applicable refund and consumer rights remain intact.

If a provision is unenforceable, it applies only to the extent permitted by law; remaining provisions continue only where lawful. No heading or summary expands the warranty disclaimer or creates a release or liability cap.

11. On-device acceptance records

The acceptance workflow uses an on-device technical receipt, not a personalized agreement PDF, identity verification, signature collection, server record or acceptance email. Watch receipt delivery is not separate acceptance. Missing, stale or mismatched receipt state must not be treated as current acceptance.

A device-reported acceptance time is not trusted server time. These Terms do not promise receipt export, indefinite retention of earlier records or recovery after reinstall, restore or pairing changes. The matching Privacy Policy describes device storage, transfers and backups. No patient or timer-session details belong in the agreement receipt.

The exact Terms and Privacy Policy must be available before acceptance. Final revision binding, continued access to accepted text and any legally required electronic-record disclosures must be qualified before activation. These Terms do not establish that those release requirements have been completed.
